GENERAL TERMS OF USE AND PURCHASE

 

1 Introduction

 

This website, www.handact.com (from now on called "Website") operates for the purpose of exhibiting and selling via the Internet the handmade products created and available for sale by the sole proprietorship "Aliki Evgeniou" (TIN 105390420), with headquarters in Athens, Megalou Alexandrou 83 (from now on called "Company"/"we").

 

This (together with any document referred to herein) sets out the terms governing the use of the Website and the purchase of products through it (the "Terms").

 

Please read these Terms, Cookies Policy and Privacy Policy carefully before you start using this Website. By using the Website or placing an order through it, you agree to be bound by these Terms, the Cookies Policy and the Privacy Policy, so if you do not agree, you should not use the Website.

 

We reserve the right to modify these Terms, the Cookies Policy and the Privacy Policy at any time. It is your responsibility to read the above texts in order to know each time the terms in force at the time of entering into a transaction or any other use of the Website.

 

2. Registration on the Website

 

2.1 Registration by creating an account on the Website is optional. Each user can register on the Website by completing the relevant registration form available to him with his email address and choosing a unique password. By completing this, the registration on the Website is completed and the registered user has the following possibilities:

 

- To view the contents of his shopping cart ("My Cart"). The products that the user has chosen to order are displayed in the Cart. The user can order products, which can be reviewed or changed (delete items, change quantities) at any time until the order is completed.

 

- To complete his order and pay, by choosing one of the payment options provided by the Website.

 

-  To see his past orders.

 

- To modify his details, in case he has made orders in the past.

 

2.2. The information or personal data you provide to us either during your registration or when using the Website, in the context of your transaction with us, is subject to processing based on the Cookies Policy and the Privacy Policy. By using the Website you consent to the processing of such information and data and represent that all information and data you provide to us is true and accurate.

 

3. Terms of Sale – Procedure for ordering and purchasing products

 

For a detailed description of the order and product purchase process, see the Payment Methods & Shipping Methods section. Each order is subject to these Terms, as they apply at the time of submission. Both registered users and website visitors, without registration, can place an order.

 

After completing the order, you are asked to enter the information necessary to send your order.

 

Finally, proceed to choose the payment method.

 

The order is successfully completed when you receive an email confirming receipt of your order. Please note that this does not mean that your order has been accepted, as this is an offer from you to us to purchase one or more products. All orders are subject to our acceptance and such acceptance will be confirmed by sending you an e-mail confirming that the product has been dispatched. If there is any pending issue regarding your order or in case of partial or total unavailability of products after ordering, you will also be informed by email or phone, therefore you are invited to check your email regularly, keep and do not delete the emails that receive from us in respect of each of your orders until the completion of the transaction, with the delivery of your order. If for any reason you do not receive an informative email regarding your order, please let us know immediately.

 

4. Sale Prices

 

The selling prices of the products (in euros) are those in force at the time of placing your order, including VAT and any other taxes but excluding shipping costs, which are added to the total price. If we discover an error in the price of any product you have ordered, we will notify you as soon as possible and give you the option of reconfirming the order at the corrected price or canceling it. If it is impossible to contact you, we will treat your order as canceled and refund you the full amount you have paid. Prices may change at any time, however, subject to what is specifically stated immediately above, any changes will not affect orders for which the order has already been confirmed.

 

​5. Product shipments

 

For a detailed description of shipping terms and conditions and related charges, select the Shipping Methods section. In addition to the price of the products ordered, the shipping costs are invoiced. For orders over 49 euros, no standard postage costs are charged, excluding any additional specialized postal services that may have been requested.

 

The delivery time may change under special conditions such as weather changes, strikes, product unavailability, etc.

 

Shipping terms may be changed at any time by posting on the Website. For this reason, you are invited to be informed of the Terms each time before using the Website. In any case, before completing the submission of the order, you will know the total cost of each shipment.

 

6. Availability

 

The offer of the products is valid while the products are displayed on the Website. We make every effort to avoid problems of partial or total unavailability, in any case, if an error or unavailability occurs, you will be informed by telephone to the number you indicated when registering your details or by e-mail to the e-mail address that you have registered. In case of unavailability of a product, it is understandable that the corresponding possible charge will also be cancelled. In case of shortage and after consultation, the product will be created for you and will be sent with a relative delay of which you will be informed.

 

If you wish to cancel your order, you must contact info.hact@gmail.com within 24 hours and request the cancellation or modification of the order, as long as it has not yet been shipped. We reserve the right to cancel the order at any stage of its execution in case of non-payment of all or part of it, in case of fraud or attempted fraud in the context of using the Website.

You can pay for your order in the following ways:

 

- Cash on delivery with an additional fee

- Cash if you collect from our atelier (offline payment)

- By debit/credit card

- Via PayPal

 

8. Delivery - receipt

 

The ordered products are delivered to the address declared by you either to the designated recipient or, at the discretion of the postal service, to an identifiable third party. The recipient confirms upon receipt the good condition of the delivered products. In case these are not in good condition, the recipient must refuse the receipt and deliver a written report of the problem together with the product to be delivered. Estimated delivery time and cost are listed above.

 

9. Right of return/exchange

 

The right of return/exchange can be made within 14 working days from the date of receipt. In this case, you only bear the direct cost of returning the products (shipping costs to and from the hAct atelier)

 

The right of return/exchange cannot be exercised for products that have been used or damaged after receipt. Your right only applies to products that are returned in exactly the same condition as you received them, together with the documents, retail receipt and packaging that came with the product. No refund will be given if the product has been used after opening, if the product is not in the same condition as delivered or if it has been damaged. Therefore, you must take good care of the products while they are in your possession. Please return the products using or including their original packaging, instructions and any other documents that may have accompanied the products. In any case, you must return the products together with the receipt you received upon delivery.

 

In case of product return, your refund will be completed within 30 days from the date we receive the products. The refund will be made using the same payment method you used for the original transaction.

 

10. Ownership – Trademarks

 

The content of the Website, the “hAct” logo “handact.com” and the hAct mark are the property of the company. Your access to the Website should not be construed as a grant, therefore following, conclusively or otherwise, any license or right to use any symbols appearing on this website, without our prior written consent or any third party owner thereof.

 

11. Hyperlinks

 

The Website may contain links to other websites. We are not responsible for their content, links, services and products they may provide. When you click on the link, we no longer have any authority, involvement or responsibility regarding the collection, processing and use of the personal data transmitted to third parties.

 

12. Limitation of Liability

 

Except as otherwise expressly provided in these Terms, our liability with respect to any product purchased through the Website is strictly limited to the amount of the purchase price of such product.

 

Subject to the preceding paragraph and to the fullest extent permitted by law, we accept no liability for the following, however caused:

 

a. Loss of income or revenue

b. Loss of commercial activity

c. Loss of profits or contracts

d. Loss of expected savings

e. Loss of data, and

f. Loss of time management or working hours.

 

Due to the open nature of the Internet and the possibility of errors in the storage and transmission of digital information, we do not guarantee the accuracy and security of information transmitted to or received from the Website, except as otherwise expressly provided herein. You are entirely responsible for the implementation of the IT and telecommunications means that allow access to the Website and the knowledge of using and accessing the Internet.

 

All product descriptions, information and material posted on the Website are provided "as is" and without any further warranty either express or implied, except for warranties provided by law. In this light, if you are dealing as a consumer or as a user, we are obliged to deliver products that are in accordance with the transaction between us, taking responsibility for any lack of conformity that exists at the time of delivery. To the maximum extent permitted by law, we disclaim all warranties, except those to consumers and users who cannot be legally excluded.

 

13. User Obligations

 

You agree and undertake that you will not use the Website to send, post, email or transmit in any other way any illegal, offensive, threatening, harmful, defamatory, abusive language to harass third parties and generally to commit acts that constitute an infringement of the applicable Greek and Community legislation. Also, you may not infringe any trademark or infringe any confidential information, trade secret, copyright or proprietary rights of any third party, upload, post, or transmit in any way any advertising, promotional or disruptive material, or materials, files, programs or other codes that contain viruses that in any way affect the software and in general that are designed to damage, destroy or interfere with the operation of computer software. You also may not seek or gain access to an account that you are not authorized to access, test the vulnerability of the system or network or breach security or identification measures or induce any third party to do any of the above . You agree to comply with all general local, national or international regulations regarding the use of and transmission of information over the Internet.

 

We are entitled at any time, in case of any non-compliance or violation of these Terms and Conditions, to initiate all legal proceedings and to terminate the use of the Website in whole or in part, without prior notice expressly reserving to claim compensation from him for any losses or damages resulting from the this behavior.

 

14. Invalidity of term

 

In the event that one of these Terms is declared invalid in any way (law, court decision, etc.), the other terms will still apply.

 

15. Events of Force Majeure

 

We will not be liable or responsible for any failure to perform or delay in performing any of our obligations under a Contract caused by events beyond our reasonable control (Force Majeure Event).

 

A Force Majeure event is any act, event, impossibility, omission or accident beyond our reasonable control.

 

The performance of our obligations under any contract shall be deemed to be suspended for the duration of the Force Majeure Event and the time for the performance of our obligations shall be extended by a period of time equal to the duration of the period in question. We will make every reasonable effort to end the Force Majeure Event or find a solution to enable us to fulfill our obligations despite the Force Majeure Event.

 

16. Law and Jurisdiction

 

The use of the Website as well as the transactions that take place through it are governed by Greek law.

 

Any dispute arising from or related to the use of the Website or the transactions that take place through it shall be subject to the exclusive jurisdiction of the courts of Athens.
